*The ModSpace Ultimate Confidence Pledge applies to single-wide temporary offices, the ModSpace HQ and ModSafe portable storage containers in the U.S. only. The On-time Delivery & Pick-up Guarantee applies only to qualifying single-wide equipment (the "Equipment") with a lease term of no less than six months. If ModSpace does not deliver or remove the Equipment on or before the date promised by ModSpace in writing, then the ModSpace Customer shall receive either a credit or a refund check equal to one month of base rent (the "Rebate"), after expiration of the Lease term. This guarantee assumes disclosure by the ModSpace Customer of all known site conditions and is subject to the provisions of Section 3(c) of the Lease, including, and without limitation, acts of God, natural disasters, hurricanes, windstorms, war, terrorism, unforeseen loss of employees or facilities, highway restrictions or other events beyond the control of ModSpace. The ModSpace Customer is responsible for obtaining all permits and regulatory approvals necessary for delivery or removal of the Equipment and as otherwise set forth in the Lease. The Customer must be current on all payments due to ModSpace in order to receive the Rebate. The Rebate is Customer's sole and exclusive remedy for failure to deliver or remove the Equipment by the date agreed to by ModSpace.
