MODSPACE FILETS ON THE WAY REFERRAL PROGRAM OFFICIAL RULES

NO PURCHASE NECESSARY TO ENTER AND NO OBLIGATION OF ANY KIND IS IMPLIED. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.  PARTICIPATION CONSTITUTES REGISTRANT'S FULL AND UNCONDITIONAL AGREEMENT TO AND ACCEPTANCE OF THESE OFFICIAL RULES.

The sponsor of the ModSpace Filets on the Way Referral Program is Modular Space Corporation, 530 East Swedesford Road, Wayne, PA 19087.

The ModSpace Filets on the Way Referral Program (known as "Referral Program") runs from December 3, 2007 to April 30, 2008.

PARTICIPANT REGISTRATION
· Participants (known as "Registrants") must register their company information and mailing address via the Internet on www.modspace.com.
· Registrants will enter referral contact information via the Internet on www.modspace.com for companies that may require products and services from ModSpace (known as "Referrals").
· Eligible Products are defined as a storage container lease, in-fleet modular building lease, and/or a custom/in-fleet modular building sale or lease.
· If ModSpace receives two or more referrals from different program Registrants, ModSpace will honor the first referral received based on the date and time received.
· Referrals for the registrant's own account will not be eligible for awards.

AWARD REDEMPTION
· Eligible registrants will be sent a program award certificate when ModSpace closes (signs) 3 leases (for a period of one or more months) or sales of Eligible Products.
· ModSpace will notify by email Referral Program registrants when they are eligible to receive a program award.
· Participants are responsible for the accuracy of their mailing address at the time of the award. P.O. Boxes will not be accepted.
· ModSpace will mail program awards to each program registrant's shipping address.
· The award certificate may be redeemed at the registrant's convenience with Omaha Steaks, Inc. Registrants select from options available in the Omaha Steaks "Chairman's Collection", up to a $149 value.
· Awards selected will be distributed by Omaha Steaks, Inc. as directed by the Registrant.
· ModSpace is not responsible for Omaha Steaks items shipped to a registrant's shipping address.
· ModSpace is the sole arbiter of any dispute arising from or related to the Referral Program.
· All Federal, State, and/or local taxes, fees, costs, and other expenses related to the prizes awarded and the Referral Program are the sole responsibility of Registrant.

ELIGIBILITY
· The Referral Program is offered to all natural persons age 18 and over as of the date of registration who are legal residents of the United States and Canada.  
· ModSpace customers, prospects and other companies requiring products and services from ModSpace are eligible to enter the Referral Program.
· ModSpace employees, officers, directors and relatives of ModSpace employees are not eligible for Referral Program awards.
· ModSpace reserves the right to substitute the award with another that has the same approximate retail value at its discretion.
· ModSpace reserves the rights to interpret, change, and/or add to the program rules.

REFERRAL PROGRAM PRIVACY POLICY

INFORMATION COLLECTION AND USE
ModSpace is the sole owner of the information collected on this site. We will not sell, share, or rent this information to others in ways different from what is disclosed in this statement. ModSpace collects information from our users at several different points on our website.

INFORMATION YOU UPLOAD INTO MODSPACE
All client data uploaded into our system is stored in a personalized and secure location. ModSpace will not sell or rent any client data loaded into our system without prior notice to Registrants.
 
REGISTRATION
No registration is required to view the ModSpace website.

COOKIES
A cookie is a piece of data stored on the user's hard drive containing information about the user. Usage of a cookie is in no way linked to any personally identifiable information while on our general website. Once the user closes their browser, the cookie simply terminates. We use session-based cookies to determine general effectiveness of marketing campaigns. In such cases, we increment an aggregate number indicating success for that marketing campaign, but do not tie it to any of your personally identifiable information. If a user rejects the cookie, they may still use our entire site.

LOG FILES
We use IP addresses to analyze trends, administer the site, track user's movement, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information.

We will share aggregated demographic information with 3rd parties in the case they would like to know aggregate demographics of our audience. If you would like your account deactivated please state this in your communications and we will do this.

If we decide to change our privacy policy, we will prominently post those changes on our Homepage (located at http://www.ModSpace.com) so our users are always aware of what information we collect, how we use it, and under circumstances, if any, we disclose it. If at any point we decide to use personally identifiable information in a manner different from that stated at the time it was collected, we will notify users by way of an email. Users will have a choice as to whether or not we use their information in this different manner. We will use information in accordance with the privacy policy under which the information was collected.

By registering for the Referral Program, each Registrant agrees to release and hold ModSpace, its affiliates, shareholders, officers, employees, agents, and representatives harmless from any and all losses, damages, rights, claims, and actions of any kind in connection with or resulting from participation in the Referral Program, acceptance, possession, or use of any prize, including without limitation personal injuries, death, and property damage and claims based on publicity rights, defamation, or invasion of privacy.

GOVERNING LAW
All issues and questions concerning the construction, validity, interpretation, and enforceability of these Rules, or the rights and obligations of Registrants and ModSpace in connection with the Referral Program, shall be governed by, and construed in accordance with the laws of the Commonwealth of Pennsylvania without regard to the conflict of laws rules that would cause the laws of any other jurisdiction to apply.  Registrants hereby submit to the jurisdiction and venue of the State and Federal Courts of the Eastern District of Pennsylvania and waive the right to have disputes arising out of the subject matter hereof adjudicated in any other forum.
